The FYP Terms of Service
Effective Date: September 1, 2026
These Terms of Service ("Terms") are an agreement between you and Muse Computing, Inc., a Delaware corporation ("Muse," "we," "us," or "our"), governing your access to and use of The FYP, including The FYP iOS app and related services (collectively, the "Services").
By creating an account, accessing the Services, or affirmatively accepting these Terms when presented, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Geographic Scope
You must be at least 18 years old and located in the United States to use the Services. By using the Services, you represent and warrant that you meet these requirements and are legally able to enter into these Terms.
2. Beta Service
The FYP is an early-stage beta service. Features may be incomplete, experimental, unavailable, changed, or removed. Data may not persist across devices, reinstalls, account changes, or Service updates unless the product expressly says otherwise. Do not rely on The FYP as the sole copy of important information or media.
3. Accounts
You must provide accurate information and keep your account and device secure. You are responsible for activity under your account. You may not share access credentials, impersonate another person, or use an account you are not authorized to use. Notify contact@thefyp.com promptly if you believe your account has been compromised.
4. The Services
The FYP lets users create and save private Stars, interact with Moments and Rooms, use private chat and AI-assisted features, receive recommendations, and use other features we make available. Some content remains only on your device. Other content is transmitted when you intentionally use a networked feature, such as chat, cloud or AI processing, notifications, or imports.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for lawful, noncommercial purposes in accordance with these Terms. Muse and its licensors retain all rights in the Services not expressly granted to you.
5. Your Content
"User Content" means photos, videos, audio, text, messages, attachments, notes, compositions, prompts, source URLs, imported material, feedback, and other content you submit, create, or direct The FYP to process.
As between you and Muse, you retain any rights you have in your User Content. You are responsible for User Content and must have all rights, licenses, permissions, and consents needed to use it with the Services.
You grant Muse a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, format, process, analyze, moderate, and display User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, and improve the Services; comply with law; and enforce these Terms. This license ends when the User Content is deleted from our active systems, except to the extent it continues in backups or must be retained for the purposes described in the Privacy Policy.
6. User-Directed Imports
The FYP may let you submit a supported Instagram or TikTok post URL through the iOS share sheet or share a supported image. When you submit a source URL, The FYP may retrieve and download the media and metadata referenced by that URL for your authenticated account.
Before using imports, you must affirmatively accept the then-current Terms. For each import, you represent and warrant that:
- you own the material or hold every right and permission needed for the import;
- Muse's downloading, storage, processing, and private display of the material to you will not violate copyright, privacy, publicity, contract, or other rights;
- your use complies with applicable law and the source platform's applicable terms; and
- the source URL and any information you provide are accurate and not misleading.
You may not import unauthorized, infringing, unlawful, deceptive, or harmful material.
For imported material, you grant Muse only the non-exclusive, worldwide, royalty-free license needed to retrieve or receive, download, store, reproduce, process, create technical previews of, display privately to you, and delete that material as part of the Services. The license does not give Muse the right to make your beta imports shared, discoverable, or visible to other accounts.
Imports in this beta remain private to the authenticated importing account. The FYP does not autonomously select social-media posts to import for you. Instagram, TikTok, and other source platforms are independent third parties and do not sponsor or endorse The FYP.
Muse may reject, disable, or remove imported material if we receive a complaint, reasonably believe the material violates these Terms or third-party rights, or need to protect the Services. Copyright and takedown notices may be sent to contact@thefyp.com. Muse intends to investigate and remove disputed material promptly where appropriate.
Muse is not representing that The FYP currently operates a formal Digital Millennium Copyright Act safe-harbor program under 17 U.S.C. Section 512. The FYP must not expand imported material into cross-account sharing, discovery, recommendations, or autonomous agent selection without a separate copyright-program review.
7. Acceptable Use
You may not use the Services to:
- violate law or another person's intellectual-property, privacy, publicity, contractual, or other rights;
- upload, import, transmit, or distribute material you are not authorized to use;
- exploit, sexualize, or endanger a minor;
- threaten, harass, abuse, defraud, deceive, or impersonate another person;
- facilitate violence, self-harm, illegal activity, or other serious harm;
- submit malware, harmful code, or content designed to compromise a system;
- gain or attempt unauthorized access to an account, system, or data;
- evade security, moderation, usage limits, or access controls;
- scrape, crawl, copy, or extract the Services or their output at scale;
- use the Services or their output to build or train a competing service without Muse's written permission; or
- interfere with the operation or integrity of the Services.
We may investigate suspected violations and suspend, restrict, or terminate access when reasonably necessary.
8. AI-Generated and AI-Assisted Results
The Services use artificial intelligence. AI-generated or AI-assisted output may be inaccurate, incomplete, misleading, offensive, non-unique, or outdated. Muse does not guarantee that output is original, accurate, suitable, or non-infringing.
Output is provided for general informational and creative purposes. It is not legal, medical, financial, mental-health, or other professional advice and must not be used for emergencies or as the sole basis for an important decision. You are responsible for evaluating output and for how you use it.
To the extent permitted by law and subject to third-party rights, you may use output generated for you. Other users may receive similar output.
9. Third-Party Services and Content
The Services may rely on, display, retrieve, or link to third-party services and content. Muse does not control and is not responsible for third-party services, availability, content, policies, or conduct. Your use of a third-party service may be governed by separate terms and policies.
10. Muse Intellectual Property
Muse and its licensors own the Services, including the software, design, branding, and underlying technology, excluding User Content owned by users or third parties. You may not use Muse or The FYP names, logos, or branding without written permission.
If you provide feedback, you grant Muse a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as its source without permission.
11. Service Changes
We may add, modify, suspend, or discontinue any part of the Services. We may impose or change limits on features, storage, or access. Where required by law, we will provide notice of material changes.
12. Suspension, Termination, and Account Deletion
You may stop using the Services at any time. You may request account deletion through the in-app flow.
We will remove your account and associated personal information from our active systems within 30 days after your request, subject to the retention exceptions described below and in the Privacy Policy.
We may retain limited information for longer when reasonably necessary to comply with law or legal process, maintain security, prevent fraud or abuse, resolve disputes, enforce these Terms, or keep a record that we completed a deletion request. We may also retain de-identified information that can no longer reasonably be linked to you.
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, fail to meet eligibility requirements, or if suspension or termination is required to protect the Services, Muse, users, or others.
After termination, provisions that by their nature should survive will remain in effect, including provisions concerning ownership, licenses, disclaimers, liability, and disputes.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MUSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MUSE DOES NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, SECURE, UNINTERRUPTED, ERROR-FREE, OR AVAILABLE; THAT CONTENT WILL BE PRESERVED; OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MUSE AND THE OTHER MUSE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID MUSE FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
15. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any rights you have under applicable law, legal proceedings arising out of or relating to these Terms or the Services must be brought in the state or federal courts located in New York County, New York, and you and Muse consent to those courts' jurisdiction.
These Terms do not require arbitration and do not contain a class-action waiver. Muse may adopt a different dispute-resolution provision only through an updated, legally reviewed version of the Terms and any notice or renewed acceptance required by law.
16. Changes to These Terms
We may update these Terms as the Services change. We will identify the effective date of the updated Terms and provide notice or request renewed acceptance when required. Changes apply prospectively unless otherwise stated or permitted by law. Continuing to use the Services after an update takes effect constitutes acceptance where permitted by law.
17. General Terms
These Terms and the Privacy Policy constitute the entire agreement between you and Muse concerning the Services unless another written agreement expressly applies. If a provision is unenforceable, the remaining provisions remain effective. Muse's failure to enforce a provision is not a waiver. You may not assign these Terms without Muse's written consent. Muse may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
